The Supreme Court on Thursday dismissed the pleas challenging the Calcutta High Court order granting bail to former Andaman Chief Secretary Jitendra Narain in a Port Blair gangrape case.
An apex court bench of Justices Vikram Nath and A. Amanullah dismissed the petitions.
"We find that the High Court was right in not dealing with the respective arguments. We have refrained ourselves from referring to certain facts. We have dismissed all the petitions. We have directed the UT to look into the complaints of safety made by the victim," the bench's verdict was quoted by Bar and Bench.
The order was passed in appeals filed by complainant woman and Union Territory (UT) of Andaman & Nicobar Islands against a High Court order of February 20.
After the bail was granted, the survivour moved the SC to stay the HC order stating the accused might try to destroy the evidence taking advantage of the bail.
A bench of Justices Krishna Murari and Ahsanuddhin Amanullah had then issued a notice on the woman's plea, which contended that the Calcutta High Court Circuit Bench at Port Blair granted bail to the accused IAS officer "in a very casual manner" without considering the woman's objections, reported the Indian Express.
Following the rape allegations, Narain was suspended by the Centre in October last year.
Meanwhile, advocate Pathick Chandra Das, representing the survivour said that Narain was given conditional bail. Certain conditions were laid down by the court including he was not allowed to enter the Andaman and Nicobar Island unless called for.
“He was also not allowed to make phone calls to any officials and the victim. He was also directed to deposit his passport so that he could not leave India,” said Das.
