The Delhi High Court, on Tuesday, set aside an order by Patiala House Court and said that Aam Aadmi Party MP Raghav Chadha can continue to stay in his government bungalow. Chadha had challenged a trial court order that lifted an interim order, which allowed the Rajya Sabha secretariat to have him vacate the government bungalow allotted to him.
Justice Anup Jairam Bhambhani said the April 18 order of the trial court, which had directed the Rajya Sabha Secretariat not to evict Chadha, stands revived, a PTI report reads. The trial court had ruled that Chadha had no right to continue staying in the government bungalow allotted to him for the entirety of his term once it had been cancelled.
The allotment of the MP bungalow for Chadha had been cancelled after he was suspended from the Rajya Sabha. He was suspended after allegedly forging signatures of MPs and recommending them for a committee without their consent.
On Monday, The Supreme Court sought a response from the Rajya Sabha Secretariat on the petition filed by AAP leader and lawmaker Raghav Chadha, who challenged his indefinite suspension from the upper House and sought the assistance of the attorney general in adjudicating the issue.
The Rajya Sabha Secretariat was sent a notice by the SC regarding the plea which will be heard on October 30. the SC also asked Attorney General R Venkataramani to assist it in dealing with legal issues related to the suspension of a lawmaker from the Upper House, a PTI report reads.
Delhi High Court has asked Chadha to present the plaint before the trial court within three days. It has also asked the trial court to proceed with the matter by deciding the e AAP leader’s application under Order 39 Rules 1 and 2 of CPC. The court also maintained that the Rajya Sabha Secretariat, a permanent administrative office of the Rajya Sabha, is a separate and distinct institution from the Government.
