Krishna Janmabhoomi case: Supreme Court dismisses plea challenging Allahabad HC order

The petitioner has sought declaration of conterversial site as Krishna Janmabhoomi

The Supreme Court on Friday dismissed a plea challenging a recent Allahabad High Court order rejecting a PIL demanding recognition of Shahi Eidgah Mosque site in Mathura as Krishna Janmabhoomi.

The Supreme Court refused to entertain the plea and said the PIL was rejected to avoid multiplicity of litigation, as there were similar petitions pending before the court, LiveLaw reported. Hearing Advocate Mahek Maheshwari’s petition, a bench comprising of Justices Sanjiv Khanna and Dipankar Datta said the petition was rejected since it was filed as PIL and said counsel was free to file it as a separate petition. 

"We are not inclined to interfere with the impugned judgment and hence the special leave petition is dismissed. We clarify that the dismissal of the special leave petition nowhere comments on the right of parties to challenge the vires of any enactment or prevents or bars any party from challenging the vires of any enactment," LiveLaw reported quoting the judgment. 

Meanwhile, the mosque committee has moved the Supreme Court challenging a recent Allahabad High Court order that allowed a court-monitored survey of the Shahi Idgah adjoining the Krishna Janmabhoomi temple in Mathura. The high court, on December 14 last year, had agreed to the appointment of a court commissioner to oversee the survey of the mosque premises which, the Hindu side claims, hold signs suggesting that it was a Hindu temple once.
