A Delhi Court has attached the Bikaner House in the national capital, owned by the Nokha Municipal Council in Rajasthan, to settle dues of Rs 50.31 lakh it owes to a private firm. The Court directed that a representative of the Council should appear before it during the next hearing.
The Patiala House Court has attached the Bikaner House owned by the municipal council after the Nokha civic body failed to settle arbitral award of Rs 50.31 lakh in favour of private company Enviro Infra Engineers Private Limited. District Judge Vidya Prakash ordered the attachment after the Nokha body failed to honour the arbitrary settlement ordered in 2020.
"Keeping in view the fact that the Judgement Debtor (Nokha Municipality Council) had failed to comply with the direction for furnishing an affidavit of their assets despite grant of repeated opportunities, the Court, while agreeing with the submissions made on behalf of Decree Holder (DH), finds it a fit case for issuance of warrants of attachment against immovable property of JD namely Bikaner House, New Delhi," the judge ordered, PTI reported.

The Patiala Court also restrained the Nokha Council from transferring or charging the property by sale, gift or otherwise. The Court will hear the case next on November 29.
The Delhi Court’s move comes after the Himachal Pradesh High Court recently attached the state government’s Himachal House in Delhi, to settle its arbitrary dues of Rs 150 crore to a private firm. The Himachal Pradesh government said it will challenge the order legally.
The High Court also directed the Himachal’s power secretary to conduct a fact-finding inquiry to identify the officers responsible for the lapse in payment and sought a report.
