Opposition moves notice to impeach Allahabad HC Justice Shekhar Yadav in Rajya Sabha

Over 50 opposition MPs sign notice for impeachement. Supreme Court has sought details of controversial judge's speech

Members of the opposition in Rajya Sabha have submitted a notice to impeach Allahabad High Court Justice  Shekhar Yadav for his controversial remarks. Over 50 opposition MPs have signed the notice for impeachment of Justice Yadav.

Rajya Sabha MP Kapil Sibal said, "We have given a notice to the Rajya Sabha Secretary General to impeach Allahabad High Court Justice Shekhar Kumar Yadav.  We believe that the judge has no right to hold that post and he should be removed,” ANI reported.

Sibal said the High Court judge made inflammatory remarks on Court premises on December 9. “This is not a political issue but an issue of protecting the Constitution and the independence of the judiciary. We urge Prime Minister Narendra Modi, Union Home Minister Amit Shah and leaders of the ruling party to join us in protecting the Constitution,” he added.

Sibal, who also heads the Supreme Court Bar Association said the apex court should order the removal of the controversial judge and no work should be assigned to him until a decision has been taken on the motion.

Meanwhile, the Supreme Court has taken note of Justice Yadav’s controversial comments and has sought details from the Allahabad High Court. Apparently, Justice Yadav’s roaster at the Allahabad Court has been changed and from December 16, he will hear only first appeals – cases arising out of orders passed by district courts, and that too only those filed up to 2010, Bar and Bench reported.

The Allahabad High Court made controversial comments while attending an event organised by the legal cell of right-wing organisation Vishwa Hindu Parishad. Justice Yadav said India will function as per the wishes of the majority community and added, “I vow that this country will surely enact a uniform law, and it will happen very soon," the publication reported.
