The Bangladeshi national arrested for allegedly attacking Bollywood actor Saif Ali Khan at his residence has moved a Mumbai court for bail, alleging the charges against him false. The attacker also claimed the probe in the case is almost over and his detention doesn’t serve any purpose.
Mohammad Shariful Islam Shehzad, the Bangladeshi national who allegedly attacked Bollywood actor Khan approached the Sessions Court and sought bail in the case. Shehzad claimed, “The first information report is patently false and a false case has been registered against him,” PTI reported.
Shehzad claimed his arrest was illegal and the investigating agency had "clearly and blatantly disregarded" section 47 of Bharatiya Nagarik Suraksha Sanhita (BNSS). The section pertains to informing a person about the grounds of his arrest and right to bail.
The attacker argued that even if the witnesses' statements are taken as “gospel truth”, it does not fulfil charges under sections filed against him. “The statements don’t fulfil the ingredient of the Bharatiya Nyaya Sanhita (BNS) section 311 (robbery or dacoity committed with the intent to cause death or grievous hurt),” PTI reported.
He also argued that Mumbai police have completed the necessary recovery and discovery in the case and only filing of the chargesheet is pending. He claimed his further detention did not serve any purpose. The sessions court will hear the matter on April 1.
Bollywood actor Khan was attacked in his flat in Bandra in January. The attacker allegedly sneaked into the flat located on 12th floor of the residential building in Bandra. He threatened to attack Khan’s young son and demanded a ransom of Rs 1 crore. The actor got into a scuffle with the attacker and the latter escaped after stabbing Khan six times. Khan underwent multiple surgeries at Lilavati Hospital and is recovering.
