The Delhi police claimed it had earlier probed Mishra’s role in the riots and no incriminating evidence was found against the minister. However, the court said there was cognizable offence against Mishra and directed a probe. It is clear that Mishra was in the area at the time of the alleged offence and further probe is required, the judge said.
The petitioner Ilyas claimed in his plea that he saw Mishra and others blocking a road in Northeast Delhi's Kardampuri and destroying vendors’ carts during the riots. He also alleged the then Delhi Police DCP was standing next to Mishra, Bar and Bench reported.
The Delhi riots erupted during the protests against the Citizenship Amendment Act (CAA) and the National Register of Citizens in the national capital in 2020.
