A US court has ruled that Tahawwur Rana, a Canadian businessman with Pakistani roots, can be extradited to India over his involvement in the 26/11 Mumbai terror attacks.
The US Court of Appeals for the Ninth Circuit on August 15 said the extradition treaty between the US and India permits Rana's extradition. He can still appeal against the latest ruling.
The three-judge panel's ruling has affirmed a California district court's denial of Rana's habeus corpus petition, challenging a magistrate's certification for extradition. The panel included Milan D Smith, Bridget S Bade and Sidney A Fitzwater.
The court said India has submitted sufficient competent evidence to back the magistrate judge's finding of probable cause that Rana committed the charged crimes.
A jury had earlier convicted Rana of providing material support to a foreign terrorist organisation and conspiring to provide material support to a foiled plot to carry out terrorist attacks in Denmark. However, the jury acquitted him of conspiring to provide material support to a terrorist organisation that carried out the 26/11 attacks in Mumbai.
